What Does Legally Separated Mean in Ontario

In Registry v. Registry, the parties had been married for 25 years when they separated. The husband had been the main breadwinner throughout the marriage and currently earned about $150,000 as a steel mill foreman and local councillor. The woman had stayed at home in the traditional role of housewife to care for her children. Unlike divorce, married and unmarried spouses can legally separate. Once separated, spouses can apply for spousal support and child support (if there are children). However, only married couples can claim compensation for net family patrimony – common-law spouses must invoke fair claims to claim property rights. When spouses separate, it is recommended that they manage their affairs through a separation agreement or court order.
